Question: Recently laid off, no health insurance and my ex husbands insurance is 2ndary but refusing to cover medical...?

I'm the non custodial parent who is currently laid off w/ out insurance whose kids 2ndary insurance refuses to pay. I have always had health insurance along with paying child support, however since being laid off I have not had health insurance on them, but manage to pay support with unemployment benefits. My ex husband said his insurance who is the kids 2ndary insurance provider is now calling him about payment and are refusing to pay anything demanding I get health insurance per Divorce decree/ court order as they will not cover. Again, Im not working and havent had luck finding anything so I started going to school. I thought since there is no longer a primary, the secondary will kick in? I understand it was in a COURT ORDER I provide it, but I have no job but do pay the support. is there any way around this so his ins. will cover the medical? He gave me his ins.info to call them to get this squared away. Which I have spoken to them in the past and provided my unemplyment info. They want my current husband to add them to his insurance now since I've remarried and my spouse has insurance?!! Please help, I dont see why the 2ndary wont cover the medical fees till I get insurance since I'm suppose to be primary per divorce decree... i've tried! It sounds like your ex is jerking you around. Either he dropped the kids from his insurance plan, or his insurance company is trying to rip him off. Contact an attorney that specializes in insurance claims and discuss this. It may be the best $30 you ever spent. |

I think you asked this yesterday. You need to show the "secondary " that the "primary " coverage has terminated, making them "primary ". If they refuse, you can file a complaint, in writing, with your state insurance commissioner. They shouldn't be making you jump through those hoops, though - it's not up to THEM to enforce the child support order. Your current spouse cannot add the children to his policy, unless you're within 30 days of losing your job. These are IRS rules. |

They won't cover, because there is a court order that says they don't have to cover it! Even if they turn into the primary, they are still not responsible because of the court order. |
